Dear [Lawmaker],

As a Maryland small-business leader, I have serious concerns about SB 387, HB 895, and HB 1475.

To stay efficient and competitive, I rely on data-driven pricing tools available through digital platforms like Amazon, Walmart, and Shopify. These tools help me respond to demand, manage inventory, and keep pace with the market. Finding the right balance between what customers are willing to pay and earning a sustainable profit while often operating on thin margins is a constant struggle — and it’s one reason over half of small businesses fail within their first five years. Today’s technology helps me efficiently find that balance.

The dynamic pricing bills under consideration will make many of these pricing tools impossible to use or prohibitively expensive, and will force me to navigate complex definitions and burdensome disclosure requirements. Making matters worse, I'll face the risk of costly class-action lawsuits for even minor infractions. Reducing my access to these tools will also raise costs for consumers, disproportionately hurting those in low-income communities who depend on greater choice and money-saving promotions. Lastly, these bills would put Maryland small businessses at a competitive disadvantage against competitors in other states who will still be able to use these tools.

No one should face unfair discrimination, and the Maryland Civil Rights Act rightly prohibits discriminatory pricing. But anyone who has negotiated the price of a car, purchased jewelry from a pawnshop, or haggled on Facebook Marketplace understands that individualized pricing is not new or nefarious. Today’s technology simply allows small businesses to use such pricing, efficiently and fairly, to grow and succeed.

For these reasons, I urge you to reject SB 387, HB 895, and HB 1475.
