Protect Patients Now – Pass the NSA Enforcement Act!

The No Surprises Act (NSA) was a historic step forward in protecting patients and safeguarding access to care. However, weak enforcement is allowing insurers to delay payments, disregard Independent Dispute Resolution (IDR) determinations, and exploit procedural gaps, all of which undermines the way that Congress intended the law to work.

Physicians across the country are experiencing the consequences of this reckless disregard firsthand.  The IDR process was designed to be the cornerstone of the NSA, but without meaningful enforcement, it cannot function as intended.  When insurers fail to comply, patient access to care is threatened and confidence in the system erodes.

The No Surprises Act Enforcement Act (H.R. 4170/S. 2420) is an important bipartisan legislation that will empower courts to compel insurers to follow the law – including the very important Independent Dispute Resolution (IDR) process. As a result, the NSA Enforcement Act will make real the promises of the NSA: that patients are protected, providers are fairly paid, and the healthcare system works as intended.
