I urge you on behalf of Oregon residents and the state’s recreational businesses to address the state’s unique recreational liability crisis. Passing up another opportunity to do so will lead to even higher insurance costs for ski areas and other businesses and soaring costs for Oregon consumers. It may even force businesses to close. Oregon’s problem stems from a 2014 decision by the Oregon Supreme Court invalidating broad liability waivers that protect recreational businesses from negligence claims. Such waivers, which customers sign voluntarily before skiing, rafting or engaging in similar activities, acknowledge that they participate at their own risk. Because such waivers are now virtually meaningless in Oregon, recreational businesses face substantial lawsuit risk. That has led to a liability insurance crisis that has driven up the cost of coverage for Oregon businesses. And this has led to higher costs for Oregonians. SB 1593 would move Oregon into alignment with the many other states that honor liability waivers. By moderating insurance costs, SB 1593 would improve affordability for Oregonians. Failing to address this problem would drive prices increasingly out of reach for consumers and threaten the existence of many businesses in Oregon’s recreational sector.
