Stop the 7-OH Ban in Kansas!

Kansas legislators are deciding whether to regulate kratom products responsibly or move toward policies that could effectively ban 7-OH products and criminalize adult consumers.

History shows prohibition does not improve safety — it removes guardrails, eliminates product standards, and pushes people to unregulated sources.

I am writing to urge you to vote NO on SB 497.

While I share the Legislature’s goal of protecting public health and youth safety, HB 2765 and SB 497 would move Kansas toward a prohibition-style policy on certain kratom products. Prohibition does not eliminate demand, it removes oversight.

Criminalizing or effectively banning these products will not protect consumers. Instead, it risks pushing adults toward underground alternatives that lack testing, quality standards, and accountability. In those environments, regulators lose visibility, bad actors gain opportunity, and risks increase, especially for young people.

Kansas has a clear and responsible alternative: regulation rather than prohibition. Sensible consumer-protection policy should:

•	Establish and enforce age restrictions

•	Require accurate labeling and ingredient disclosure

•	Implement manufacturing, purity, and product-testing standards

•	Give regulators enforcement authority against unsafe or adulterated products

•	Prevent unsafe black-market sales rather than unintentionally encouraging them

A science-based regulatory framework allows Kansas to protect consumers while maintaining oversight and accountability. HB 2765 and SB 497, by contrast, risks moving these products out of regulated retail environments and into unregulated channels where safety protections no longer exist.

Kansas has the opportunity to adopt thoughtful, balanced policy that prioritizes safety, transparency, and enforcement instead of approaches that historically drive markets underground.

Please oppose HB 2765/SB 497 and instead support policies focused on responsible regulation and consumer protection.
