Dear [Lawmaker],

As a small business owner in Vermont and ZYN retailer, I urge you to reject SB 198, which would dramatically increase the tobacco licensing fee in the state and would unfairly raise the tax on smoke-free nicotine products like ZYN.

An excessive new licensing fee on retailers, who choose to sell tobacco and nicotine products to adult consumers, would harm small businesses like mine that sell such products. Not every retailer can absorb a ten-fold increase in the fee they pay each year to sell nicotine products. If fewer stores are able to maintain their licenses, it will lead to less competition, less revenue, less overall economic activity, and could lead adult consumers to turn to an illicit market for smoke-free nicotine products in the Green Mountain State.

An increased tax on smoke-free nicotine products could make them less affordable for adults to purchase these products. Nicotine pouches like ZYN have provided a solution to adult consumers seeking to transition from their use of traditional tobacco products that are known to carry higher risks. Excessively taxing smoke-free nicotine products could inadvertently drive individuals back to smoking or lead them to cross state lines to purchase products where they are more affordable, resulting in lost revenue for the state.

Ultimately, the licensing fee and tax increases on smoke-free nicotine products would only hurt small businesses and adult consumers in Vermont. As your constituent, I urge you to oppose SB 198, and as a ZYN retailer, I will be following this issue closely.
