We are writing to express our deep concern about S.2619, the data privacy bill that recently passed the Massachusetts Senate, and H.4746, a similar bill currently being considered in the House. Though well-intentioned, S.2619/H.4746 would significantly harm small businesses like ours — making it harder for us to advertise effectively, understand our customers, and grow.
Data-powered digital ads help us reach customers interested in our products, and data-based insights provided by our digital partners help us improve our marketing strategies. None of this involves any sensitive or personally identifiable data — it’s simply about reaching the right audience.
If passed, S.2619/H.4746 would severely restrict this valuable data, making it harder and more expensive for small businesses like ours to reach new customers, generate repeat customers, and compete against larger companies. Making matters worse, we are also concerned that the bills’ complex compliance requirements would make us easy targets for predatory lawsuits we simply cannot afford.
We respect our customers’ privacy and support sensible data privacy regulations. But S.2619/H.4746 go too far. We urge you not to overregulate the data that powers small businesses’ most effective digital advertising tools.
